Terms of Service

These Terms of Service (the “Terms”) are a binding agreement between you and Take 220 Productions LLC (“Take 220 Productions LLC”, “we”, “us” or “our”), operator of ListingTranslate (the “Service”) — a tool that translates or edits the text inside product images you provide. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who can use the Service

You must be at least 18 years old and able to form a binding contract. If you use the Service on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to that organization.

2. Your account

You sign in with an email magic link or a Google account through our authentication provider. You are responsible for keeping access to your inbox and account secure and for all activity that occurs under your account. Tell us promptly if you believe your account has been accessed without authorization.

3. What the Service does

You upload one or more images and choose a translation or a find-and-replace edit. We send your images to a third-party AI image model, which produces new image files in which the text is translated or edited while the surrounding artwork is preserved as closely as the model allows. The Service returns those files to you. It does not read, change, or publish anything on any marketplace or storefront on your behalf.

4. Acceptable use

You are responsible for the images and instructions you submit. You represent that you own the images or have all rights and permissions needed to upload them and to have them edited. You agree not to use the Service to:

• infringe anyone’s copyright, trademark, publicity, privacy, or other rights;
• create or alter images to deceive — including forging documents, currency, identification, certifications, or safety and regulatory marks, or misrepresenting a product’s origin, contents, or claims;
• produce unlawful, defamatory, or sexually exploitative content;
• bypass, overload, or interfere with the Service, our rate limits, or the third-party providers behind it, including through automated scraping or bulk abuse.

You are solely responsible for reviewing each image the Service returns before you use it. AI output can contain errors, including mistranslations or altered detail.

5. Credits and payment

The Service runs on prepaid credits. One credit produces one image. New accounts receive one free welcome credit; additional credits are sold in one-time packs with no subscription. Key rules:

• Credits are consumed only on success. A credit is charged when an image is produced successfully. If an image cannot be produced, no credit is charged.
• Rerolling a successful result to get a different image costs one credit each time. Retrying a failed image is free.
• Credits never expire, are non-refundable, and have no cash value.

Purchases are handled by our payment processor; we do not receive or store your full card details. Prices and pack sizes may change, but changes do not affect credits you have already bought. Refunds and your statutory rights are described in our Refund & Cancellation Policy.

6. Your content and intellectual property

As between you and us, you retain all rights to the images you upload (“Input”) and to the images the Service creates for you (“Output”). You grant us a limited, worldwide, royalty-free license to host, process, and transmit your Input and Output solely to operate and provide the Service to you — including sending them to the AI provider to fulfill your request. We claim no ownership of your Input or Output. We own the Service itself, including our software, design, and trademarks; these Terms grant you no rights in them beyond use of the Service.

7. Third-party services

The Service depends on third parties — for AI image editing, payment processing, authentication, hosting, and (for the Amazon workflow) fetching public listing data you request. Their availability, output, and terms are outside our control, and their handling of data is described in our Privacy Policy. We are not responsible for third-party acts, omissions, or outages.

8. Disclaimers

The Service and all Output are provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that Output will be accurate, error-free, or accepted by any marketplace, and we do not provide legal, compliance, or regulatory advice. The Service does not verify translations or check any listing against marketplace or legal requirements — that remains your responsibility.

9. Limitation of liability

To the maximum extent permitted by law, Take 220 Productions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) fifty U.S. dollars (US$50). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

10. Indemnification

You agree to indemnify and hold Take 220 Productions LLC harmless from any claims, damages, and expenses (including reasonable legal fees) arising out of your Input, your Output, or your use of the Service in breach of these Terms or applicable law.

11. Termination

You may stop using the Service and delete your account at any time from your account settings. We may suspend or terminate access if you breach these Terms or misuse the Service. When an account is deleted, its images and results are removed and any unspent credits are forfeited without refund, as described in the Refund & Cancellation Policy.

12. Changes to the Service and these Terms

We may change the Service or these Terms. When we change these Terms, we update the “Last updated” date above; material changes take effect when posted, and your continued use of the Service means you accept the updated Terms. If you do not agree, stop using the Service.

13. Governing law and disputes

These Terms are governed by the laws of the State of «STATE» and applicable U.S. federal law, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in «STATE» for any dispute that is not otherwise subject to a binding alternative process, except that either party may seek injunctive relief in any court of competent jurisdiction. Nothing here removes mandatory consumer-protection rights available to you where you live.
